Minister Flávio Dino (Justice and Public Security) presented this Thursday (26) to President Luiz Inácio Lula da Silva (PT) a package of legal actions in response to the January 8 attacks in Brasília.

The package of measures provides for two bills, a provisional measure and a PEC (Proposed Amendment to the Constitution).

They are: Creation of a national guard responsible for protecting the Esplanade and the Praça dos Três Poderes; regulation of social networks, on the grounds that it is necessary to prevent the internet from being used to disseminate anti-democratic content; tougher punishments for those who violate the democratic rule of law; and a project to reorganize public security competencies in the Federal District.

The measures must be presented by President Lula to Congress in response to the attacks. On the 8th, supporters of former President Jair Bolsonaro (PL) invaded and destroyed the headquarters of the three Powers.

The Ministry of Justice is studying, for example, punishments such as the loss of public office and the impossibility of taking part in public examinations, in addition to the creation of new criminal types for those who attempt against the lives of the heads of the three Powers.

On another front, the PT government wants to impose obligations on big techs to reduce coup content.

In this context, companies will have to submit periodic transparency reports detailing how they removed or reduced the reach of illegal content and adopt measures to mitigate the risk of dissemination of these publications.

In cases where there is a court order to remove content, the company will have a period of two hours to remove the publication. The deadline is similar to that adopted by the TSE (Superior Electoral Court) in the final stretch of the elections.

In the case of the Electoral Court, the fine per hour of non-compliance would range from R$ 100,000 to R$ 150,000.

In summary, the proposals presented to Lula deal with the following topics:

Dino announced that he would send the proposals to Lula in an interview with the press. During the statement, the minister said that the rules related to social networks are not considered by the government to be a regulation on big techs.

“It’s not a criminal law, [a medida provisória] only creates rules for the platforms. It is not regulation of the internet, it is not to be confused with the theme of fake news. Likewise, we believe that the platforms will have their own responsibilities, with the removal of content, and there may be sanctions. It’s something very focused exclusively on crimes aimed against the democratic rule of law and terrorism,” he said.

According to Dino, the proposals must be analyzed by Lula and other areas of the government before being sent, in February, to the National Congress.

This Thursday, the Ministry of Justice holds the first meeting with all the Public Security secretaries of the states since the new governments took office. The main agenda, according to Dino, is the discussion on changes in the transfer of funds from the National Fund for Public Security.

According to the minister, R$ 2.3 billion are dammed up in state funds for bureaucratic reasons. The lack of use of resources is due, says Dino, to rules established in decrees and ordinances that make it difficult to use resources quickly — such as the need for states to present a work plan to the Ministry of Justice before having access to the money already transferred .

“The idea is to eliminate bureaucracy and we are seeing [com os secretários] if it is possible to make a temporary norm to speed up, for the states to spend this money. We followed the execution and practically two thirds of the amounts passed in previous years have not yet been sworn in”, said Dino.

The secretaries still have to discuss the change in the policy on weapons, with the creation of a working group for the elaboration of infralegal measures for a deeper alteration on the commercialization and use of weapons.

This is the model pointed out by the specialists and the Brazilian experience”, said the National Secretary of Public Security, Tadeu Alencar, at the beginning of the meeting.
