Federal deputy Deltan Dallagnol (Podemos-PR) will tell the Chamber of Deputies that 12 of the 15 proceedings against him at the CNMP (National Council of the Public Ministry) are based on “illegal evidence”.
This is one of the main defense arguments adopted by the parliamentarian to try to reverse the impeachment imposed on him by the TSE (Superior Electoral Court).
A Sheet had access to an excerpt of the document that must be presented by hand to the Internal Affairs of the House on the afternoon of this Tuesday (30), the date that closes the deadline for him to forward the document. The parliamentarian has until the time of the end of the plenary session to present the defense.
On the last 16th, the TSE unanimously revoked the registration of the candidacy and, consequently, the mandate of federal deputy of the former coordinator of the task force of Operation Lava Jato in Curitiba.
The action is a result of representation from the Brazilian Federation of Hope (PT, PC do B and PV) and from the PMN, who alleged that Deltan could not have left his career as a public prosecutor to enter politics because he responded to disciplinary complaints, investigations and request for measures with the CNMP —which supervises the functional duties of the members of the Public Prosecutor’s Office.
In addition to pointing out procedures that would be based on illegal evidence, “in whole or in part”, Deltan also claims that there would be three cases of prescription.
Such as Sheet showed last week, the internal affairs department of the Chamber tried to notify the deputy three times, without success, to inform him of the TSE’s decision, and the communication was made in the Official Gazette.
Once the defense is presented, the corregidor will have a period of 15 working days (with a possible extension for the same period) to offer his opinion to the Board of Directors of the House for the official declaration of the loss of mandate. Currently, the Corregedoria is headed by federal deputy Domingos Neto (PSD-CE) — the entire procedure runs in secrecy.
In general, the Corregedoria analyzes only formal aspects of the court’s decision. It is not for the body, therefore, to analyze the merits of the determination and its possible reversal.
