Deltan finds an alternate who claims a vacancy; see video – 05/17/2023 – Power

The day after the decision by the TSE (Superior Electoral Court) that annulled his mandate, federal deputy Deltan Dallagnol (Podemos-PR), who had 345,000 votes, met in the plenary of the Chamber with the alternate of his party who claims his vacancy : Luiz Carlos Hauly (Podemos-PR).

He had 11,925 votes in the 2022 election and was not elected.

In the brief conversation that took place on Wednesday night (17), which also included the participation of deputy Coronel Tadeu (PL-SP) and former deputy Afredo Kaefer (PR), the former coordinator of Operation Lava Jato in Curitiba he listened to jokes and advice about his situation and limited himself to smiles and a few monosyllables.

Upon meeting Deltan, Hauly made the former prosecutor legal considerations about the possibility of taking over his vacancy. “The guy at the courthouse doesn’t want any spots for us. [do Podemos]. (…) I didn’t ask for any of that, I was in my comfort”, said the former deputy to Deltan.

Hauly was a federal deputy for seven terms, but was unable to be re-elected in 2022, becoming a substitute.

The Regional Electoral Court of Paraná decided that the vacancy should be occupied by Itamar Paim (PL), a pastor from Paranaguá, who had 47,000 votes, as reported by the Panel.

The Podemos advocated that Hauly replace Deltan, but the PL argued that he had not reached the minimum electoral quotient and claimed the vacancy. The nomination was confirmed by the Electoral Justice of the state.

Hauly, however, said he will appeal the decision, taking the final word to the TSE.

In the decision that revoked Deltan’s mandate, Minister Benedito Gonçalves, the case’s rapporteur, said that the former prosecutor’s votes should be maintained with Podemos, a thesis that, if it prevails, will give Hauly a vacancy.

“We’ll talk later, darling. Steady, steady. You’re young and you’ve got a big fight ahead of you,” Hauly told Deltan at the end.

Earlier, at the beginning of the conversation, the ex-prosecutor listened to Kaefer’s story for a few minutes.

“You were impeached and I was almost the victim! You almost fell into my lap”, exclaimed Kaefer when he saw the former Lava Jato coordinator. It is not possible to know, just by the content of the conversation, what the former deputy was referring to.

Soon afterwards, Kaefer reported that he had also been barred by the Clean Record Law.

“I’m almost a victim like you,” he said, adding that he had tried to run for office after serving a sentence to which he had been sentenced.

“The Ficha Limpa Law says that once you’ve served your sentence, you can only run eight years later. I took a risk, I went to the election, and 15 days before the TRE challenged my candidacy. Let’s say that, legally, they were even right. But there is than changing the Clean Record Law, it is not possible, this is the biggest legal aberration that exists.”

Before saying goodbye, Kaefer also advised Deltan to appeal to the STF (Federal Supreme Court).

“Supreme, with five [votos] you can do it, you know you only have ten votes [ao todo]you only have to get five”, he said, referring to the retirement of Ricardo Lewandowski, a vacancy that has not yet been replaced.

As in every conversation, Deltan just smiled and nodded.
