The Ministry of Defense wants to take advantage of the return of the parliamentary recess to advance the proposal that prohibits the military from remaining in active duty if they try to run for election or assume a position in the Executive.
A point still to be resolved is whether it will be a proposal from the government, or whether a proposal on a related topic filed by a congressman will be used, as a nod to Congress.
A wing within the PT advocates amending Article 142 of the Constitution, which deals with the Armed Forces, with the intention of barring active duty military personnel from holding civilian positions in governments, limiting Law and Order Guarantee Operations (the so-called GLOs) and ending distorted coup readings that are made of the text.
The Defense, however, opposes the change in this device. One of the PECs (proposed amendments to the Constitution), filed by former deputy Perpétua Almeida (PCdoB-AC), proposes to amend an article of the Constitution that deals with public administration.
Dubbed Pazuello’s PEC, in reference to former Health Minister General Eduardo Pazuello, the proposal puts conditions in place for active-duty military personnel to hold civilian positions at the three levels of the federation.
