Defense prepares appeal for release of Daniel Alves in Barcelona – 01/23/2023 – Sport

Daniel Alves’ Spanish lawyer, Miraida Puente Wilson, is writing an appeal asking for the player’s provisional release and hopes to hand him over to Spanish Justice this Monday (23). Alves is accused of raping a 23-year-old girl in a Barcelona nightclub on December 31. He denies it.

The information was passed to Sheet by the player’s team, which did not give details regarding the arguments of the appeal. The team denies that Alves asked for the opportunity to give a new statement to Justice and also that he changed lawyers in Spain.

In an interview with TV Record, Ney Alves, Daniel’s brother, said he preferred lawyer Andrés Marhuenda Martínez. Ney repeated his views on a program on the Spanish network Telecinco. But, according to the Brazilian’s advisory, the brothers have not spoken for years and Ney has no decision-making power.

The team also has a Brazilian lawyer, who arrived in Barcelona on Saturday, alongside Dinorah Santana, ex-wife, mother of two and current partner of Daniel Alves, and the athlete’s manager, Fransérgio Ferreira.

This Monday morning, Alves was transferred from the cell he occupied in the module reserved for detainees in the process of entry.

From Brians 1, he went on to Brians 2, in the same penitentiary complex which is on the northwest outskirts of Barcelona. At Brians 2, cells are either single or double, and the building holds fewer inmates than Brians 1.

According to the victim’s testimony, which was leaked to the press, she waived her right to claim compensation in cash as compensation for the aggression. Her goal, she says, is to get justice and make Alves pay with prison.

On Sunday, the news that Alves and the victim had spent 16 minutes in the club’s bathroom was a blow to the Brazilian’s team, which clung to other previously released information: that the time spent by the two in the area’s bathroom VIP was only 47 seconds.

Another problem was the changes in versions by Daniel Alves, who initially said he had never seen the victim. Afterwards he said that he saw her and that she had thrown herself at him. He justified that he kept the first version to protect the young woman. Later, under pressure, he finally admitted that there was sexual intercourse, but that it was consensual.

What happened at the nightclub, according to the 23-year-old told the court:

Before 2am – The victim, her cousin and a friend arrive at the Sutton Barcelona nightclub.

2h – Daniel Alves arrives with a friend and goes up to a VIP area.

Between 2 am and 3 am – The girls meet Mexican guys, who invite them upstairs to their VIP area. They accept.

Around 4 o’clock – A waiter approaches the women and says that a customer invites them to their area. At first, they reject the invitation, but the customer insists and the waiter says he is “a friend”.

• They go there, but they don’t recognize the football player. Then the Mexican boys say who it is. Daniel Alves tells them that he plays petanque, a sport very similar to boules, at the club L’Hospitalet.
• Alves and his friend offer the girls glasses of cava (Spanish sparkling wine). “Immediately he started flirting with the three of us, sticking to us a lot and touching us.”
• The player stands behind the victim, who describes the situation like this: “It was disgusting me. From behind, he took my hand, put it on his penis, and I took it off.”

4:22 am – The player points to a door and orders it to follow and enter. She says she thought it was another VIP area, but it turned out to be a bathroom.

• Inside, Alves sits on the toilet and pulls her on top of him. He asks her to say she’s “your little bitch” from him.
• Unsuccessfully, he throws her to the ground and tries to force her to perform oral sex. She resists and gets slapped.
• Then the player lifts her up, turns the victim onto her back and penetrates her “violently until she ejaculates”. “I resisted, but he was much stronger than me.”
• Alves gets dressed and says, “I’m going out first.” According to the nightclub cameras, they spend 16 minutes in the bathroom.

Just before 5am – Ten minutes after exiting the bathroom, the player leaves the club. At that moment, the victim starts crying and tells her friend and cousin what happened. They look for a local security guard, who calls the police.

• The victim is treated at the Hospital Clínic.
• Two days later, she goes to the police station to file a complaint.
