The defense of the former commander of the Military Police of the Federal District, Colonel Fábio Augusto Vieira, asked the Federal Supreme Court (STF) this Friday (27) to revoke the preventive detention. The new representation, sent to Minister Alexandre de Moraes, cites the final report released by the federal intervenor in Public Security in the DF, Ricardo Cappelli, this afternoon, informed Estadão.

Lawyers João Paulo Boaventura and Thiago Turbay argue that the report reinforces that the former commander did not participate in the planning of the security operation for January 8, a function that would be the Operational Department (DOP) of the Military Police. With that, he could not be accused of omission. The colonel’s conduct is investigated by the Attorney General’s Office (PGR) and by the PM’s Corregedoria.

“It was only after the publication of the final report of the federal intervenor that it came to the attention of the applicant [Vieira] and the other security forces, the lack of an operational plan and the necessary service orders”, says the defense.

The lawyers mention that the former commander was “a victim of physical violence in the exercise of his function” during the acts of violence on the 8th. [Vieira] in the field demonstrated that he, despite not being the Operation Commander, in charge of the DOP commands, used all the means available at the time to act to avoid the result”, says the defense in the request.
