A stf somersault helped Arthur Lira for the first time in 2021. The deputy had just been elected mayor when the court reversed a previous decision and rejected a complaint for embezzlement against the PP dome.
The same accusations that had been accepted by the Second Panel of the court in 2019 weighed against Lira – but the court was already different. The complaint was shelved thanks to a change of score produced by the retirement of Celso de Mello (aligned with Lava Jato) and the arrival of Kassio Nunes Marques (appointed to the STF by Jair Bolsonaro).
The change of chairs brought about a change in the legal and political winds of the STF. The so-called guarantor wing grew as the reaction to the Lava Jato abuses increased, encouraging the court to look for shortcuts to change decisions. In addition, some ministers sought accommodation with powerful politicians after years of what they classified as a process of criminalization of parties.
The somersault turned into a double twist in the decision that freed Lira from yet another accusation this Tuesday (6). First, the Attorney General’s Office changed its mind and withdrew a complaint filed against him in 2018 for passive corruption. The STF, which in 2019 had voted to make the deputy defendant, followed the understanding and unanimously filed the lawsuit.
The same variables of the first case appeared again: change in the composition of the court (Marco Aurélio Mello left and André Mendonça joined), Lava Jato wear and tear (the PGR argued that the accusation was based only on whistleblowing) and policy adjustments (Lira became one of the most powerful men in the country).
The combination of factors gave the Supreme Court, in tandem with the PGR, enough comfort to correct excesses of a past wave, but also boldness to adapt to the circumstances of each moment — even if, for that, it needs to minimize tests and accept a stamp political in their decisions.
