Daniel Silveira is arrested in Petrópolis, Rio, one day after losing privileged jurisdiction

Former federal deputy Daniel Silveira (PTB-RJ) was arrested this Thursday morning (2) in Petrópolis, Rio de Janeiro, for noncompliance with precautionary measures. The arrest was determined by the minister of the Federal Supreme Court (STF) Alexandre de Moraes. The Federal Police is also executing a search and seizure warrant against Silveira.

Daniel Silveira’s arrest takes place just one day after the end of his parliamentary term and the loss of privileged jurisdiction in the STF itself. In addition, Silveira was involved by Senator Marcos do Val (Podemos-ES) in the accusation that former President Jair Bolsonaro (PL) would have tried to coerce him to participate in an attempted coup d’état. In an interview with GloboNews this Thursday morning (2), Do Val said that Silveira participated, along with Bolsonaro, in the alleged coup plot.

Silveira ran for the Senate in the 2022 elections, but was unable to get elected. With the inauguration of those elected this Wednesday (1st), Silveira lost the privileged forum.

“The conduct of the defendant, who insists on disrespecting the precautionary measures imposed in these records and endorsed by the Plenary of the Federal Supreme Court, reveal his complete contempt for the Judiciary, behavior verified on several occasions during the course of this criminal action and which justified the fixation of a daily fine to ensure due compliance with the decisions of this Court”, reads an excerpt from the decision.

In April 2022, Silveira was sentenced by the STF within the scope of the investigation of anti-democratic acts to 8 years and 9 months in prison. However, the sentence was pardoned by a pardon from former president Jair Bolsonaro (PL), but the former deputy still needs to comply with precautionary measures, such as the use of electronic anklets and banning the use of social networks. Moraes had already fined the former parliamentarian for non-compliance with the precautionary measures.

“In the case under analysis, it is amply demonstrated, in the face of repeated violations, the inadequacy of the precautionary measures in ceasing the periculum libertatis of the investigated person, which indicates the need to reestablish the prison, not being envisaged, for the time being, other measures capable of complying its function”, wrote the minister.

The minister authorized the search and seizure of weapons, ammunition, computers, tablets, cell phones and other electronic devices, passports, and vehicles at the addresses of the former parliamentarian.

In addition, the PF will be able to access and analyze data, electronic files, electronic messages and emails stored on any computers, servers, networks, including Silveira’s digital cloud storage services.

Moraes determined that the PF and the Army suspend the necessary documentation for carrying a firearm, and ordered the cancellation of the former deputy’s passport.
