Former player Daniel Alves, sentenced this week to four and a half years in prison for the rape of a young woman in a nightclub in Barcelona, on December 30, 2022, will receive 1.2 million euros in compensation from the Spanish Treasury.

According to information from the Spanish daily La Vanguardia, in Barcelona, the compensation stems from a dispute that the former Brazilian national team player had with the Revenue of that country in relation to the renewal of his contract with the Barcelona team in the period of 2013 and 2014. Alves claimed that he should not declare to the Revenue the payments for the intermediation of agent Joaquín Macanás in the renewal.

The Spanish Court accepted Alves’ appeal against the case opened by the Treasury for payment for the services of a FIFA agent.

The former player’s lawyers want the amount to be returned immediately, according to La Vanguardia. They intend to use the money as bail guarantee to request Alves’ provisional release until the sentence for sexual assault is completed.

Inés Guardiola, the lawyer who defended the former player in the case of sexual assault, will appeal the conviction and is expected to ask for his release in the coming days, claiming that, as the sentence is lower than the sentences of 9 and 12 years that the Ministry Public and private prosecution, respectively, requested, there is no longer a high risk of escape.

The lawyer wants to use part of the compensation as a guarantee that Alves will not escape. She argues, according to the Spanish newspaper, that her client has no criminal record, lives in Esplugues de Llobregat (in the Barcelona region) and handed over his passport after being detained on January 20 last year.

Since his arrest, the former player has had his bank accounts frozen, unable to use them.

In Brazil, Alves is the target of a lawsuit filed by his ex-wife, Dinorah Santana, who is asking for pension payments for his two children. The process resulted in the embargo of all its capital.

For this reason, Alves turned to his friend Neymar’s father to pay 150,000 euros in civil liability required by the Spanish court during the investigation of the rape case. This amount served as a mitigating factor to reduce the former player’s sentence.
