CPMI of January 8 files a lawsuit against Cid for “abuse of the right to silence”

Faced with the silence of Lieutenant Colonel Mauro Cid in his statement on Tuesday (11), the CPMI on January 8 decided to bring the 10th Federal Court of Justice in Brasília to action against the former aide-de-camp of former President Jair Bolsonaro (PL ). In the representation filed this Thursday (13) through the Senate Advocacy, the collegiate points out that the military abused the right to silence and, therefore, would have committed the crime of “silence the truth as a witness”.
According to Article 4, II, of Law 1,579/52, it is a crime to make a false statement, or to deny or silence the truth as a witness, expert, translator or interpreter, before the Parliamentary Committee of Inquiry, reported Agência Senado. A copy of the document was sent to the Federal Supreme Court (STF), with a request for the adoption of additional measures by the Court.
Cid appeared at the CPMI supported by a habeas corpus that guaranteed him the right to remain silent in situations that could produce evidence against him. But, according to parliamentarians, he abused that right by refusing to respond to matters unrelated to the facts that could incriminate him.
“Thus, if on the one hand, as a citizen, he has the right to avail himself of the guarantees inherent in non-incrimination, on the other hand, he has the reinforced duty, as a witness, to testify to the Parliamentary Commission of Inquiry facts unrelated to this clause and that , eventually, has knowledge due to his investiture in high public functions that he exercised concomitantly with the facts under investigation”, points out the justification of the document filed in Justice.
