Court of Mines will award medal to Rosa Weber – 09/02/2023 – Frederico Vasconcelos

The president of the Court of Justice of Minas Gerais, judge José Arthur de Carvalho Pereira Filho, visited this Wednesday (8), in Brasília, the president of the CNJ (National Council of Justice), Rosa Weber, and the national inspector, Luis Felipe Solomon.

José Arthur informed Rosa Weber that she will be awarded the Judicial Merit Necklace, “on a date yet to be defined”. Maria Thereza de Assis Moura, president of the Superior Court of Justice, and Rodrigo Pacheco, president of the Senate, will receive the same tribute.

The hearings were seen as an attempt at shielding. They took place on the day that the CNJ received a request to initiate disciplinary proceedings against José Arthur and his predecessor, Gilson Lemes.

The complaint has not yet been distributed to the CNJ.

The tribute was criticized by some court judges. They consider the political moment inappropriate, envision indirect support for Gilson Lemes, who aspires to a vacancy in the STF or STJ, and consider it a manifestation of subservience.

The disciplinary complaint was filed by judge Marco Aurelio Ferenzini, from the TJ-MG.

He asks that José Arthur’s ordinance be deconstituted, which created, in 2022, the position of Institutional Legal Superintendent for Lemes, “an affront to the Full Court”.

Lemes lobbied personally, using an office set up in Brasilia at the end of his term. The space served for contacts and support for the re-election of Jair Bolsonaro.

Ferenzini demanded the immediate closure of the office, considered “an excrescence”; “invention strange to the practices of the courts”.

Last Wednesday, José Arthur’s ordinance was published determining that Lemes return to jurisdiction as of next Monday (13).

Flattery and subservience

The granting of the Judicial Merit Necklace was approved the day before, in a virtual session, by 78 judges of the Plenary. There were four votes against and one abstention.

Here are some critics from opponents:

“The embarrassment of our embassy in Brasilia and the frustrated attempt to create a vacancy for our attaché in the Federal capital, to the detriment of an honorable jurisdictional function, is long gone.”

“I suggest that this innocuous decoration be considered extinguished because, somehow, it deviates from the sober vocation of the Minas Gerais Judiciary. Without it, we preserve ourselves from this uncomfortable situation of being taken for flatterers.“

“Despite the indisputable merit of each of the names of those to be honored, I understand that this is not the right time to bestow this valuable honor, leading to a mistaken interpretation of the subservience of the Minas Gerais Judiciary Power in this current Brazilian political context, which is quite politicized and inflamed .“

Regarding the visit to the national magistrate, the TJ-MG informed in a note that the president considered “another very useful meeting with Minister Luis Felipe Salomão, who has a magnificent career in the judiciary and who is always willing and attentive with the magistrates of Minas Gerais” .

Salomão is the rapporteur for the complaint that is on the agenda for the CNJ session next Tuesday (14). It deals with the TJ-MG office in Brasilia. The court signed a contract worth BRL 607,000 with the CNC (National Confederation of Commerce), waived from bidding and valid for five years.

In June 2022, the national internal affairs department, under the management of Maria Thereza de Assis Moura, opened a procedure to investigate possible disciplinary infractions by Lemes in the installation of the office.

Ferenzini states that “there is no way to justify the daring initiative, as no court in the country has an office to serve as a logistical and administrative support base for judges and civil servants”.

The TJ-MG reported that it provided information to the CNJ about the installation of the office. Lemes said that it would be a strategic point, with the necessary infrastructure, for representatives of the Minas Gerais Judiciary to hold meetings and meetings, in addition to maintaining contacts with the superior courts and the CNJ.

Regarding support for Bolsonaro, the judge, consulted at the time, did not comment.
