Court determines registration of quota holder not considered brown by USP

The 14th Public Finance Court of São Paulo ordered the enrollment of shareholder Glauco Dalalio do Livramento, 17 years old, approved in Law at the University of São Paulo (USP), through the quota system when self-declaring as brown, which was not confirmed by the Heteroidentification Commission. The young man passed the first call for the Provão Paulista, an entrance exam exclusively for public school students, which in its first edition distributed 1,500 places at USP.

The decision was signed on Monday (4) by judge Randolfo Ferraz de Campos A USP has 72 hours to comply with the injunction and can appeal. So far, the university has not commented on the court decision.

According to the judge, the checks carried out by the commission responsible for the case, through a photo and a video call, can present distinctions and harm the candidates. “Firstly, because images generated by electronic equipment are not necessarily faithful to reality. And secondly, because it is worth considering that the decision of the Inclusion and Belonging Council (CoIP), in its 15th extraordinary session, on February 23, 2024, was taken by a majority vote of those present. It would then remain to be seen whether, if the session were in person, the same result would have been produced”, argues the judge.

The video call with the candidate for analysis by the Heteroidentification Commission lasted approximately one minute. After the USP decision, the young man went to court claiming that the cancellation was illegal and unconstitutional. In addition to Glauco, another 204 students appealed after having their self-declaration denied by USP, according to a survey by Newspaper.

Judge asks USP for explanations regarding registration of quota holder in medicine

Approved by the quota system, the student Alison dos Santos Rodrigues, 18 years old, also had his enrollment canceled in the USP medical course after the judging panel did not consider him to be mixed race. The shareholder was informed of the decision on the first day of class, on the 26th.

Rodrigues was also approved in the first call by Provão Paulista, as a candidate for a place reserved for public school students and self-declared black, mixed race and indigenous people.

On Monday (04), judge Danilo Martini de Moraes, from the 2nd Court of the Cerqueira Cesar Forum, ordered USP to clarify the reasons for refusing self-declaration of those approved in medicine within five working days.
