Court denies Nunes’ request against Boulos’ post – 03/14/2024 – Panel

The Electoral Court of São Paulo denied a request from Mayor Ricardo Nunes (MDB) for Guilherme Boulos (PSOL) to remove posts about the Datafolha survey regarding the municipal race released last Monday (11) from his social networks.

On his Instagram, the psolista published: “Datafolha confirms, Boulos is first in voting intentions”. The argument of the legal challenge was that the deputy caused misinformation by ignoring that there was a technical tie between him and Nunes, within the margin of error.

In the scenario with all pre-candidates already announced, Boulos appears with 30%, against 29% for the current mayor, with a margin of error of three percentage points.

“The disclosures characterize irregular conduct, needing to be immediately obstructed, as this form of disclosure served to forge a performance different from the real voting intentions”, argued the mayor’s lawyers.

Judge Antonio Zorz, however, accepted Boulos’ arguments that there was no false information disclosed. “Nowhere in the published illustration is there the statement that the petitioner is leading the research in isolation,” said the psolist’s defense.

For the judge, the point presented by Nunes does not have enough potential to “cause any confusion or inconvenience for those who are aware of the note [postagem]”.
