The idea of restricting the actions of STF ministers is far from being taboo. The court took a step in this direction last year, when it established deadlines for requests for views and individual decisions. In 42 seconds, the Senate managed to permeate a clean discussion with an unmistakable bad smell.
The Constitution and Justice Commission approved in a quick vote a proposal to limit monocratic decisions and determine that requests for views cannot be made by a single minister. Parliamentarians were in a hurry because they are more interested in sending messages than improving the court.
The abuse is added to attacks that propose mandates for members of the Supreme Court and the possibility of reviewing the court’s decisions. The way the package was packaged reflects a power struggle contaminated by different interests.
The first step was taken by Rodrigo Pacheco in his re-election campaign. To win the support of Bolsonarists furious with the STF, the president of the Senate committed to discussing limits for the court.
The same calculation was made by Davi Alcolumbre, president of the CCJ and candidate to succeed Pacheco. The senator embraced the agenda and commanded a rapid vote in the commission to dehydrate an opposition candidacy for control of the House in 2025.
The populist right seized the opportunity, but the anger of this group and the individual projects of Pacheco and Alcolumbre are not the only elements in the fight. Corporatism unites many congressional cardinals who feel degraded by the power exercised by the STF and fear being isolated in the face of a potential alliance between the court and Lula.
The discomfort in the Chamber and the Senate with what is seen as a double act between the Palácio do Planalto and the Supreme Court is not discreet. Some of these parliamentarians point out that they lost influence to Gilmar Mendes and Alexandre de Moraes even in discussions such as the choice of the next attorney general and the new STF minister.
