Commission repudiates decision of judge who released man who shot police

The Committee on Public Security and Combating Organized Crime of the Chamber of Deputies approved a motion of repudiation against the decision of Judge Paula Cardoso Esteves, of the 1st Criminal Court of the District of Rio Grande/RS, which granted freedom to a criminal who shot a policeman during an operation against drug trafficking, last Friday (23).

“It was with enormous surprise, consternation and indignation that we received the news of the decision of the judge that revoked the preventive detention of Anderson Fernandes Lemos, 40 years old, accused of this crime that caused irreversible damage to the policewoman”, highlighted the president of the Commission, federal deputy Sanderson (PL-RS).

According to Sanderson, “magistrates have a lot of power, but they can’t do it all. In a democracy, everyone must respect the laws. This release brought a very negative message to Brazilian society, sounding like a kind of mockery.”

The Public Security Commission also approved sending the case to the National Council of Justice (CNJ) for investigation of the situation in the administrative-disciplinary scope, where the judge may suffer disciplinary sanctions.

The officer shot was Laline Almeida Larratéa, from the 3rd Police Station of Rio Grande. She was hit in the head, left with serious sequelae and remains away from work more than a year after the incident. For the magistrate, however, there was no attempted murder, only a crime of resistance, which carries a sentence of two months to two years. Even so, the boy – who has a criminal record for drug trafficking, theft and reception – was released by the magistrate.
