Commission debates deleting the word ‘minor’ from the Civil Code – 12/27/2023 – Panel

The commission of jurists discussing the update of the country’s Civil Code will debate the exclusion of the word “minor” from the text and its replacement with “child and adolescent”, in addition to providing better legal treatment for stable unions and including digital documents as means proof in law.

The collegiate, chaired by Minister Luis Felipe Salomão (Superior Court of Justice), was installed in September this year and should complete its work in the first semester. The expectation is that the Senate will focus on updating the Code next year.

The commission, which has 38 members, wants to discuss, among other points, the issue of international personality for those in national territory, with the guarantee of fundamental rights and freedoms established in international treaties for foreigners, stateless people, asylum seekers and refugees.

Another topic will be the non-acceptance of any discrimination against a person regarding gender, sexual orientation or sexual characteristics. The group will also debate the consideration of animals as objects of law, endowed with sensitivity, which deserve different legal treatment.

Jurists must also address measures to encourage entrepreneurship, in addition to discussing the succession system and encouraging wills.

The first Civil Code was created in 1916, and its current version dates back to 2003. It is the first update in two decades, therefore.
