Head of the Operational Department of the Military Police of the Federal District on the day of the coup attacks, Jorge Eduardo Naime said this Monday (26) to the January 8 CPI that the operational arm of the corporation did not receive intelligence information and ended up being “blinded” .

“And what I find most interesting: they put the subordinate, they put the superior, but they didn’t put the DOP [Departamento Operacional]. So, at that moment, they blinded the entire operational arm”, completed the colonel.

Naime also reinforced that the Army prevented the Government of the Federal District from ending the encampment in front of the headquarters, in Brasília. He cited General Gustavo Henrique Dutra, former head of the CMP (Military Command of the Planalto), and the failed December 29 operation.

“The action of the Military Police in the camp was always limited by the Armed Forces. We didn’t have that access to enter with the police, to make arrests, to remove street vendors, to be able to make arrests. The Federal Police itself tried to carry out arrest warrants inside from the camp and was rejected by the demonstrators,” he said.

Naime was head of the PM’s Operational Department on January 8, but was on leave. The colonel claims that he would amend the so-called “reward leave” with his vacation, defined in advance, and that he could not enjoy the benefit before.

With the absence of Naime, the DOP was in charge of Colonel Paulo José. The Public Security Secretariat of the DF was in the hands of former Minister of Justice of Jair Bolsonaro (PL) Anderson Torres, who was on vacation in the United States.

In May, Minister Alexandre de Moraes denied the request for his release made by Naime’s defense — despite arguments that the military police officers allegedly involved have already been heard and that the colonel poses no risk to the investigations.

The minister stated that the officer’s conduct “under analysis is very serious”, and that it is still necessary to understand “the real reason for his absence at such a sensitive moment”. The PGR (Attorney General’s Office) also supported preventive detention.

Upon being summoned by the CPI, Naime called the STF (Federal Supreme Court) claiming that he was being investigated, not a witness. Hours before this Monday’s session, he presented a medical certificate to the commission with anxiety and depression, and asked not to testify.

The president of the CPI, federal deputy Arthur Maia (União-BA), even announced this Monday that the session would be closed without depositions. Hours later, Maia backtracked and stated that the investigated person should undergo evaluation by the medical team of the Federal Senate.

Even before the Senate announced the completion of the doctors, the colonel’s defense asked the CPI to ignore the certificate. “Today, even in a not very favorable mental condition, I decided to come here out of respect for your excellencies, out of respect for the National Congress”, said Naime at the beginning of the session.

STF Minister Alexandre de Moraes understood that, even investigated by the Court, Naime should appear before the commission and give testimony as a witness, but could remain silent so as not to produce evidence against himself.

Minister Cármen Lúcia was in the same line in relation to Mauro Cid, Bolsonaro’s former assistant, and Jean Lawand Jr., an army colonel. They must appear before the commission, but they can remain silent so as not to incriminate themselves.

Lawand must testify this Tuesday (27). In messages obtained by the Federal Police on Mauro Cid’s cell phone, the military suggests that the former president give “an order” for action by the Armed Forces. Cid’s testimony still has no date.

This Monday, the Supreme Court began the hearings of 232 criminal actions against prisoners for the coup acts of January 8. The expectation of the STF is to finalize this first block by the end of July.

They are accused of armed criminal association; attempted violent abolition of the democratic rule of law; attempted coup d’état; qualified damage; deterioration of listed heritage.

The hearings are being conducted via videoconference by four magistrates from Moraes’ cabinet. The objective is to interrogate the defendants, and hear prosecution and defense witnesses in the presence of lawyers and the PGR.
