CNJ revokes blocking of Judge Valois’ profiles on networks – 06/16/2023 – Panel

Minister Luis Felipe Salomão, national justice inspector, revoked this Thursday (15) his own decision to suspend the profiles on social networks of Luís Carlos Valois, judge of the Criminal Execution Court of Manaus (AM).

In January, the minister’s decision was based on Article 95 of the Constitution, which prohibits judges from engaging in “party-political activity.” On his social networks, Valois published texts on various political topics, with criticism of the impeachment of Dilma Rousseff, Operation Lava Jato and the government of Jair Bolsonaro (PL) and his supporters.

After the coup attacks on the headquarters of the Three Powers on January 8, for example, he wrote a tweet referring to Vaza Jato, that is, with a veiled criticism of Lava Jato.

“To those who are in need of criminal lawyers, beware of lawyers who think it is normal for the judge to combine the conviction with the prosecutor in a Telegram group”, he wrote.

In his reconsideration, Salomão wrote that unlike other cases in which there is “incitement to anti-democratic social conduct that goes beyond the exercise of activity, in theory, party-political, such as statements indicative of prejudice, discrimination, hatred and even incitement to social movements that celebrate principles and conduct contrary to the democratic rule of law”, such circumstances were not verified in the publications of the magistrate Valois.

The minister also points out that the judge did not insist on the conduct by similar means, such as profiles on other social networks.

Valois tells the Panel that he continues to respect the decisions of the National Justice Department and that he accepts “this one with serenity and happiness, because he understands that it is fair in relation to my position, always concerned with the democratic rule of law.”

The magistrate is known for his criticism of the conditions of the national penitentiary system. In 2017, triggered by the Secretariat of Public Security of Amazonas, he participated in the negotiation of the release of hostages at the Anísio Jobim Penitentiary Complex, in Manaus, when 56 prisoners were killed.
