CNJ opens procedure to investigate conduct of Lava Jato judge in Curitiba

The Corregedoria Nacional de Justiça (CNJ) opened a procedure called to investigate the conduct of federal judge Gabriela Hardt, from the 13th Federal Court of Curitiba, regarding the conduct of the Lava Jato Operation processes.

According to the communiqué published on Tuesday (18), the initiation of a “disciplinary complaint” occurred after a request filed by businessman and former state representative Tony Garcia.

The jurist alleges, in the petition, that Gabriela Hardt would have acted with partiality in the conduct of actions and “violation of the principle of impersonality”.

In the decision, the national justice inspector, Minister Luis Felipe Salomão, points out that the investigation is justified “in view of the fine line that separates simply jurisdictional acts from those that have correctional relevance, as well as the peculiar caution that affects the performance of the National Internal Affairs of Justice”.

According to Garcia, Gabriela Hardt was aware of “potentially criminal facts committed by the then judge Sérgio Fernando Moro and by federal prosecutors, but remained inert”. The businessman also points out that there is a violation of the principle of impersonality, as the magistrate would have conducted, sometimes with unusual speed, sometimes with unjustified delay, processes involving him.

Salomão gave a period of 15 days for the magistrate to comment on the complaint. Gabriela Hardt was recently transferred to the 3rd Appellate Panel of Paraná.
