The National Council of Justice opened, this Tuesday (14), two administrative disciplinary proceedings against Judge Ludmila Lins Grilo, from Minas Gerais, for evidence of negligence in the exercise of the judiciary and political-partisan manifestations in social networks, hurting ” the ethics and decorum of the office”.

Ludmila became famous for ostensibly supporting Jair Bolsonaro’s candidacy for the Presidency, criticizing decisions by superior courts, participating in party-political acts and publicly encouraging disobedience to anti-Covid measures.

The collegiate determined the precautionary removal of the magistrate, who is responsible for the Criminal, Jury and Childhood and Youth of the region of Unaí (MG).

According to the opinion of the rapporteur, Minister Luis Felipe Salomão, National Inspector of Justice, the judge did not fulfill her basic duties. She did not attend the forum, neglected the notary and failed to supervise the work of subordinates.

In September 2022, Salomão ordered an extraordinary correction on Ludmila’s rod. He appointed judge Carlos Vieira von Adamek to coordinate the correction, with assistant judges Cristiano de Castro Jarreta Coelho and Joacy Dias Furtado. The three are from TJ-SP.

The extraordinary correction identified 1,291 cases paralyzed in the notary, several of them from arrested defendants.

According to Salomão’s report, Ludmila was intensely active on social media, harshly criticizing higher court ministers, in addition to commenting on the decisions of these collegiate bodies and ongoing processes.

In July 2020, the then national inspector Humberto Martins filed a request for action against Ludmila Grilo. She was accused of calling on social media for political demonstrations in favor of Bolsonaro and encouraging non-compliance with the use of anti-Covid masks.

Martins understood that there was not sufficient just cause to initiate a complaint or administrative disciplinary process.

At the time, Ludmila maintained in the records that, “until a state of defense or state of siege is decreed – the only possible hypotheses for restricting the right to assemble (commonly known as “agglomeration”, a trigger word successfully used to ban debate) – I will continue sustaining the legal unfeasibility of the lockdown and the restrictions of freedoms via municipal decrees”.

During the session this Tuesday, Ludmila made her own defense, stating that she received guidance from the Institutional Security Office (GSI) of the TJ-MG on alleged threats against her life.

However, he dismissed the police escort, because he understood that it would not be enough to guarantee his protection and decided to stop working in person.

During the inspection, she had confirmed that she was absent from the forum every day, even without authorization from the TJ-MG presidency.

“It is clear that the non-conformity with the decisions handed down is based on an untrue narrative of persecution and placing Judge Ludmila Lins Grilo in the position of someone who suffers injustice and deprivation due to her behavior in confronting the current justice system”, said the national inspector.

Salomão commented that “several magistrates suffer threats throughout Brazil, including threats related to their profession (which is not the case of the claimant), but certainly the solution adopted is not the absence of work”.
