Claro’s biometry becomes the target of an investigation by the MPF – 07/20/2023 – Panel SA

The Federal Public Ministry opened a civil investigation against Claro for requiring customers to collect biometric data in cases of transfer of ownership of telephone lines. The operator’s alleged infringement occurred in a store at Shopping Iguatemi in Porto Alegre (RS).
Attorney Jorge Irajá Louro Sodré states that Claro has conditioned the service to identification by facial biometrics.
The LGPD (General Data Protection Law) determines that the capture of data by biometrics depends on consent.
For Idec (Brazilian Institute of Consumer Protection), refusal cannot result in curtailing access to the company’s goods and services.
Via advisory, Claro stated that it uses biometrics and document validation to prevent fraud in the identification process and says that it informs its customers about its privacy policy, which is open to customers.
