The Corregedoria of the Chamber of Deputies tried to notify federal deputy Deltan Dallagnol (Podemos-PR) three times, without success, to inform him of the TSE (Superior Electoral Court) decision to revoke his mandate.

This formal act allows the opening of a period of five working days for the parliamentarian to present his defense to the House.

According to an act of the Board of Directors of the Chamber, the Corregedoria has three attempts to notify the parliamentarian. If there is no success, the notification is published in the Official Gazette of the Union and, the next day, the deadline for the defense becomes valid.

The corregidor, in turn, has a period of 15 working days to offer his opinion to the Board of Directors for the official declaration of the loss of mandate.

Last Tuesday (16), the TSE unanimously revoked the registration of the candidacy and, consequently, the mandate of Deltan, former coordinator of the Operation Lava Jato task force in Curitiba. On Wednesday (17), the court sent notification to the Chamber to communicate the decision.

Since then, Internal Affairs has tried on three occasions to notify the deputy in his office: on Thursday (18), on Friday (19) and on the afternoon of Monday (22).

A Sheet accompanied the third attempt. Two representatives from Internal Affairs were at Deltan’s office early this Monday afternoon, but the parliamentarian is in Curitiba.

A Deltan advisor, then, signed a notification term and questioned whether it was “standard” for Internal Affairs to conduct this type of procedure on “dates that, normally, deputies are on the base”. And she heard in response that there is no such distinction.

In a note, Deltan says he has been away from the Chamber since last Thursday in meetings with his lawyers and leaders of Podemos. “Since Friday I’ve been in Curitiba, my base in Paraná, like all the other deputies do”, she says.

“The Corregedoria told us that it gave the deputies the opportunity to schedule the receipt of the notification as a courtesy and we sent an email on Thursday requesting an appointment for this week, when I was in Brasília. But we were never answered. three notification attempts when I was evidently neither in the Chamber nor in Brasilia”, he says.

The possibility of scheduling notification, however, is not included in the act of the Board of Directors of the Chamber.

According to Sheet found out, the idea of ​​Deltan’s allies was to hold a public act in defense of the parliamentarian, with the participation of other deputies, on the day of notification.

Currently, Internal Affairs is headed by Federal Deputy Domingos Neto (PSD-CE). According to the parliamentarian’s interlocutors, he has stated that he does not want to make the process spectacular and that he will follow the rites dictated by law, with impartiality and neutrality.

“It is important to highlight that the body is only responsible for the formal aspects of the decision of the Electoral Court. In the end, it will be up to the Board of the Chamber of Deputies to declare or not the loss of mandate, as provided for by the Federal Constitution”, wrote Neto on social networks on Thursday. In general, the Corregedoria analyzes only formal aspects of the court’s decision. It is not for the body, therefore, to analyze the merits of the determination and its possible reversal.

There is no forecast for a vote in the plenary or some kind of debate in the House on the TSE’s decision. Thus, Deltan’s only chance of reversing the situation would be to obtain an order from the STF (Federal Supreme Court) to suspend the effects of the Electoral Court’s decision.

In the assessment of members of the court, however, it is unlikely that he will get a majority in the plenary in his favor.

Deltan’s impeachment action stems from the representation of the Brazilian Federation of Hope (which brings together the PT, PC do B and PV) and the PMN, who claimed that the parliamentarian could not have left his career as a public prosecutor to enter politics because responded to investigations, disciplinary complaints and requests for action at the CNMP (National Council of the Public Prosecutor’s Office) —which supervises the functional duties of members of the Public Ministry.

Speaking to the press on Wednesday, Deltan said he lost his mandate for fighting corruption. “There is only one truth, I lost my mandate because I fought corruption. Today is a day of celebration for the corrupt and a day of celebration for Lula”, she said at the time.
