CBM-AP command cancels exclusion of soldier who reported having suffered sexual harassment – News of Brazil

The General Commander of the Military Fire Brigade of Amapá, Colonel Alexandre Veríssimo de Freitas, annulled the decision of the report of the Disciplinary Council of the corporation that, unanimously, had decided to exclude the soldier Karla Samara Costa dos Santos, for the sake of discipline, in a process that has been ongoing since 2021.
The decision of the current CBM command came after a legal opinion from the State Attorney General’s Office (PGE-AP), which guided the annulment of the exclusion procedure, offering an argument that was considered solid. The opinion states that there were procedures riddled with illegality during the course of the 2021 Disciplinary Board.
“Convinced of the correctness of the analysis of the aforementioned opinion, it is up to the command of the corporation to proceed with the annulment of the act practiced based on the procedures, the solution published in the Official Gazette of Amapá 7.678 of May 30, 2022, as arising from illegality, is found it is also tainted and subject to the application of administrative self-protection”, says an excerpt from the annulment, which is dated April 28 and was published this Friday (12).

As News of Brazil showed in several reports, Karla Samara began to face problems in the Fire Department in 2018, when she denounced that she had been the target of sexual harassment by the captain of the institution Helder Souza da Silva, getting her emotional state shaken, taking medicine controlled and receiving psychological assistance. The soldier was assigned to the Fire Department’s communication sector, as a journalist.
The alleged harassment, as it was widely publicized on social media, allegedly took place in May 2017, in Brasília, where Karla Samara traveled in a delegation from the Fire Department, which also included Captain Helder. The entourage went to the federal capital for the Corrida do Fogo, which took place there.
Karla denounced the hierarchical superior to the Command of the Fire Department, which opened an administrative procedure to investigate the complaint. The procedure, according to lawyer Marlon Nery, exempted the officer from guilt when he decided to close the case, at the same time that he pointed soldier Karla Samara as the author of ‘disciplinary transgression’.
