Carandiru: OAB will go to the STF against Bolsonaro’s pardon – 02/06/2023 – Mônica Bergamo

The Federal Council of the OAB (Ordem dos Advogados do Brasil) decided to join the action that questions the last Christmas pardon signed by Jair Bolsonaro (PL) and the pardon granted by him to all military police officers convicted of the Carandiru massacre, which took place in 1992, in Sao Paulo.

The entity will present to the STF (Federal Supreme Court) a request to join as amicus curiae (friend of the court) —that is, as an interested party in the cause— in an action filed by the PGR (Attorney General of the Republic).

The Attorney General of the Republic, Augusto Aras, asks the court to immediately suspend the effectiveness of a section of the decree, as a way of “avoiding the emptying of the dozens of convictions in the case”.

The OAB’s decision to join the case was taken this Monday (6), during the entity’s full council session. The proposal is authored by the president of the National Commission for Constitutional Studies of the OAB, Marcus Vinicius Furtado Coêlho.

“The request for entry as amicus curiae takes into account the commitment of the OAB with the defense of the Constitution, the legal order of the democratic rule of law, human rights and social justice”, says the national president of the OAB, Beto Simonetti.

The pardon granted by then-president Jair Bolsonaro did not name the police officers, but the text describes circumstances that fit the situation of the 74 convicted of murdering the prisoners. The case completed 30 years in October last year.
