Manaus (AM) – The mayor of Manaus (CMM), councilor Caio André (Podemos), proposed, in court, the summoning of those approved in the public tender held in 2003. However, the Legislative House depends on the judicial decision that will determine how the call will be made.

The CMM had been making efforts to comply with the decision of the Superior Court of Justice (STJ), which requires the personal notification of candidates for appointment and investiture, after a long period of time has elapsed from the approval of the competition, to prevent candidates from being harmed . However, 20 years after the event took place, there are difficulties in locating those approved, so that personal notification can be made.

The CMM appealed to the judge in the case, Ronnie Frank Torres Stone, so that the Public Ministry of Amazonas could intervene in the notification of those approved. However, for the prosecutor Antônio José Mancilha, who sent a statement to the judge this Monday (4), disclosure via the internet, radio and television should be adopted for the summons.

As stated in a petition sent by the CMM Attorney’s Office to the 4th Public Finance Court of the Capital this Monday, and signed by attorney Sílvio da Costa Bringel Batista, the Manaus City Council is not opposed to proceeding as required by the Public Ministry, provided that authorized by the judge, since, according to the case law of the STJ, the non-personal notification of the interested party violates the principles of publicity and reasonableness.

If authorized by the judge, the City Council of Manaus, proposes the nomination of all approved candidates within the number of vacancies, within three working days of the decision. The term for possession will be 30 days, counted from the date of publication of the provisional decree.

After the nominations in the Official Gazette, the Legislative House, in response to the request of the Public Prosecutor’s Office, will also publicize those summoned in mass communication vehicles (radio, television and internet), thus being released from the personal communication or notification of the candidates. , for all legal purposes.

The Manaus City Council makes itself available for immediate compliance with the sentence, which becomes final, even though it has not been summoned for this purpose to date, which proves the good faith of the current administration in making the respective appointments.

The Legislative House points out that it repudiates the statement that it has adopted an omissive or procrastinating conduct, since the process has been, over these 20 years, under the protection of justice, which it returned from the STJ only in May of this year, and was petitioned at the Public Ministry only in July 2023.

CMM Contest

The CMM public tender was one of the first commitments signed by President Caio André right at the opening of legislative activities, on February 6th. On the occasion, the councilor stated that the competition would be included in the 2023 budget so that it could be carried out the following year.

According to the President of the House, the CMM is running a voluntary retirement program that involves civil servants with more than 30 years of service.

Still according to the president of CMM, the number of vacancies in the next contest will depend on the number of employees who apply.
