BRL 177 thousand in one month

A law approved in March by the Legislative Assembly of Goiás and sanctioned by Governor Ronaldo Caiado (União Brasil) raised the salaries of judges to more than R$ 170,000, according to an investigation by the newspaper O Estado de São Paulo published this Monday (3 ). The value is four times higher than the constitutional limit of R$ 41.6 thousand, which is the remuneration of a Minister of the Federal Supreme Court (STF).

The salaries of judges from Goiás, he points out, are the highest among the courts in the country and are made up of the remuneration itself and a series of frills and specific state rules. The values ​​were raised based on the law that had the project proposed by the president of the Court of Justice of Goiás, Carlos Alberto França.

The text transformed bonuses for commissioned positions and functions into indemnity funds that are outside the constitutional mechanism of “ceiling slaughter”, which inhibits the receipt of “super wages” in public administration. Thus, says the TJ-GO, the state “strictly complies with the law and that all its decisions, judicial and administrative, are published in the form of the law”.

A survey by Estadão based on the May payroll shows that the judge Wilson da Silva Dias, for example, received R$ 177,400 in salary in the month, after deducting Social Security and Income Tax. In addition to remuneration of R$36,400, Dias received R$47,000 in compensation, R$42,800 in benefits and R$48,800 in bonuses.

The judge’s earnings were greater than that of the president of the TJ-GO, Carlos Alberto França, who received R$ 149.9 thousand in remuneration in the month: R$ 26.6 thousand in salary, R$ 30.5 thousand in indemnities , R$87,000 in benefits and R$20,100 in bonuses. In all, points out the calculation, almost 200 judges from Goiás received salaries above R$ 100 thousand in May.

The increase in wages above the constitutional ceiling caught the attention of the Attorney General of the Republic, Augusto Aras, who filed a direct action of unconstitutionality (ADI) at the Federal Supreme Court (STF) on May 15.

“It is inadmissible to create immoral laws whose purpose is to privilege a few individuals. […] Benefits of this nature, moreover, usually have certain and determinable recipients, which, moreover, implies contravention of the principle of impersonality”, he said in the petition to the Court.

The action in the STF fell into the hands of Minister André Mendonça, who determined on Friday (30) that the governor of Goiás and the presidents of the Legislative Assembly and of the state and municipal audit courts demonstrate until the end of this week.

Aras questioned five laws, two of which govern the benefit for Executive servants and three others that expand the perks for the top leadership of the TJ-GO, for the Court of Auditors of the State of Goiás (TCE-GO) and for the Court of Accounts of Municipalities (TCM-GO).

The Estadão also points out that the 450 magistrates of the TJ-GO earn, on average, R$ 78.5 thousand, being the highest of all the 84 courts that have already submitted data to the National Council of Justice (CNJ) this year.

In second and third place are the Military Court of Justice of Minas Gerais (TJM-MG), with an average of R$ 71 thousand net, and the Court of Justice of Santa Catarina (TJ-SC), with R$ 66 thousand .
