Brasilia DF) – In a defense presented to the Superior Electoral Court (TSE), the team of lawyers for former president Jair Bolsonaro (PL) claims that the draft of a decree on the 2022 presidential election found in the house of former minister Anderson Torres is apocryphal and, for this reason, it should be disregarded.

According to the defense, the material “was not published or publicized, except by the investigative bodies” and that “there is no news of any measure of transposition from the world of the paper draft to that of phenomenal reality, that is, never went beyond the plane of cogitation”.

On January 10, during a search and seizure operation at the former minister’s house, the PF found the proposal for a decree for then-president Jair Bolsonaro to establish a state of defense in the TSE after having lost the election to Luiz Inácio Lula da Silva (PT).

The state of defense is provided for in Article 136 of the Constitution. The mechanism allows the president to intervene in “restricted and determined places” to “reserve or promptly restore public order or social peace threatened by serious and imminent institutional instability or affected by calamities of great proportions in nature”.

The draft of the decree also provided for the formation of a commission made up of Bolsonaro and members of the Ministry of Defense to supervise the TSE.

Material would be discarded, said the former minister

Arrested since last Saturday (14), Anderson Torres used his social networks on the same day that the material was found by the PF to defend himself.

According to him, the document would be discarded and was “leaked out of context.” “As Minister of Justice, we are faced with hearings, suggestions and proposals of the most diverse types. It is up to those who occupy such a position, the discernment to understand what effectively contributes to Brazil ”, he said in the post.
