AGU requests blocking of BRL 18.5 million from attack funders – 01/19/2023 – Power

The AGU (Attorney General of the Union) asked that the value of blocking the assets of individuals and companies that would be involved in the coup attacks on the buildings of the three Powers rise to R$ 18.5 million.

The request was made through a precautionary action filed by the body, responsible for the legal representation of the government, this Thursday (19), in the Federal Court of the Federal District.

The AGU justified that the addition considers reports from the sub-command for legal matters of the Presidency of the Republic, which estimated damages of BRL 7.9 million to the assets of the Palácio do Planalto, and of the STF (Federal Supreme Court), which calculates at BRL 5 .9 million damage to its building.

According to the body, the new amount is also an updated value of the damages estimated by the general directorate of the Chamber of Deputies, who informed it to be R$ 1.1 million. The amount would not include the restoration of damaged works of art and the destruction and subtraction of ceremonial gifts “whose value is inestimable”.

“In this context, in view of supervening information, it appears that the estimated minimum damage is undersized, which is why the Union comes to court to request the addition of the initial to amend and add a new element to the cause of action and a new request regarding the increase of the damage once established as a parameter for the granting of a precautionary measure”, says the document.

The AGU had initially requested the freezing of R$ 6.5 million in assets of 52 people and seven companies that financed the charter of buses for the acts.

At the time, federal judge Francisco Alexandre Ribeiro fully accepted the requests, stating that it was “absolutely plausible” that those involved “contributed to the achievement of massive damage to public property, and are therefore subject to considerable civil liability”.

It was decided that the amount should be used to repair damage caused by the depredation of public property in case of subsequent conviction.

The magistrate pointed out that, even in licit popular meetings and demonstrations, there is a risk that individual feelings rise and cause the so-called “herd effect” and that it would be predictable that the meeting of thousands of demonstrators with an agenda “exclusively angry and hostile ” the outcome of the elections could lead to “concrete practices of violence and depredation.”

It was also decided to notify the Central Bank, the Securities and Exchange Commission, the Private Insurance and National Supplementary Pension superintendencies, notary offices, port captaincies, the National Traffic Department and the National Aviation Agency, for the necessary measures to block of the property and rights of suspects.

The list of targets, according to the AGU, was drawn up with the help of ANTT (National Land Transport Agency).
