Parliamentarians aligned with former president Jair Bolsonaro (PL) and critics of the performance of the STF (Supreme Federal Court) delivered this Friday (21) to the representative of Brazil at the UN, in New York, a complaint against what they call “very serious violations of human rights” of the approximately 1,500 arrested for the coup acts of January 8.

The entourage was made up of senators Carlos Portinho (PL-RJ), Magno Malta (PL-ES), Eduardo Girão (Novo-CE) and deputy Marcel van Hattem (Novo-RS).

They met with Sérgio Danese, Brazil’s representative at the UN, to report the complaint, said Senator Carlos Portinho, who also said that the trip was paid for with his own funds.

“We have people arrested beyond the period of preventive detention, lawyers without access to investigations and processes, a limitation of the right to defense, in addition to the situation of people, as seen in visits by senators, arrested with comorbidities, with cancer, autistic, various violations”, he said.

The document delivered to Danese was signed by more than 10 senators and nearly 90 deputies, he added.

Marcel van Hattem said that an English translation will be filed next week in Geneva at the UN Human Rights Commission. “In addition, we are looking at other ways to denounce the abuses that are taking place in Brazil in international forums. Including the Inter-American Commission on Human Rights of the OAS [Organização dos Estados Americanos] has already received several complaints and we will soon make one from deputies and senators”, he pointed out.

The complaint mentions “very serious violations of the human rights of around 1,500 Brazilian citizens who were persecuted, arrested and subjected to inhuman, illegal, unconstitutional and incompatible treatment with the precepts established in international treaties to which Brazil is a signatory, including the International Covenant on Civil and Political Rights.”

It also says that Lula’s candidacy for the presidency “was only possible thanks to the subsequent intervention of the Supreme Court —composed of a majority of ministers appointed by the winning party—, which set the candidate free and gave him back his political rights, in addition to having acted, through its electoral arm —the Superior Electoral Court (TSE), in frank support through decisions that sometimes benefited Lula’s candidacy, sometimes harmed the opposing candidacy.”
