Minister Luís Roberto Barroso, of the Federal Supreme Court (STF), revoked the suspension of payment of the national nursing wage floor. The law was approved by Congress last year, but was suspended by the magistrate until the financial impacts and funding sources were detailed. The law with the definition of funding was approved by Congress this year and sanctioned by President Luiz Inácio Lula da Silva (PT) and provides for R$ 7.3 billion for payments.

For the public sector, the start of payments must comply with Ordinance 597, of the Ministry of Health. In the private sector, amounts must be paid for days worked from July 1, 2023. In practice, the minister partially revoked the injunction that suspended the floor, in order to enable its implementation. The stretch of Law 14.434/2022 that prevented collective bargaining in any situation remains suspended, according to the Court.

Barroso’s decision will be analyzed by the virtual plenary from May 19. “Barroso noted, however, that the amount of BRL 7.3 billion reserved by the Union does not seem to be able to pay for all the resources needed to implement the minimum wage. Information contained in the file shows that the financial impact of implementing the national nursing salary floor, in the first year, would be BRL 10.5 billion for the municipalities alone”, said the Court, in a note.
