The Minister of the Federal Supreme Court (STF) Luís Roberto Barroso rejected the request presented by federal deputies to summon the Minister of Justice, Flávio Dino, to explain criticisms about the electronic voting machines. Dino questioned the safety of the ballot boxes in posts made on social networks between 2009, 2012 and 2013.
The publications were retrieved by federal deputy Nikolas Ferreira (PL-MG). Barroso considered, in this Tuesday’s decision (11), that it is not the competence of the Supreme Court to judge the request for explanations presented by the parliamentarians. The request of the deputies was presented on Monday (10).
“So that it is not up to the Federal Supreme Court to process a request for interpellation, or notification, of a civil nature, in the face of an authority that holds, in criminal matters, jurisdiction by prerogative of function in this Court”, wrote the minister.
“Thus posing the question, in the absence of the indispensable prerequisites for knowing the request, there is no alternative but to recognize the impropriety of the chosen procedural route”, pointed out Barroso. Minister Nunes Marques was drawn as rapporteur for the case, but as the Court is on duty due to the recess of the Judiciary, the decision was taken by Barroso, who is vice president of the Supreme Court.
Dino celebrated Barroso’s decision in the social media. “Today, another lawsuit filed against me by the extreme right was filed. There are several dismissals of delirious actions, even for me to be arrested. Meanwhile, I continue to do my work, based on the Constitution and the laws, with a clear conscience and a lot of faith,” said the Minister of Justice.
