The National Council of Justice (CNJ) approved in October a resolution that guarantees the equality of “rights and duties” of judges and members of the Public Ministry. In practice, the newspaper revealed Folha de S.Paulothe rule paves the way for the creation of new frills in the salaries of magistrates across the country.
In the Federal Court, for example, a benefit was created that can increase the remuneration of federal judges by 30% of their gross salary. It is enough for them to add administrative functions to the work of judging. Instead of extra money, they can choose to take ten days off a month. If they prefer financial compensation, there will be no income tax on the amount.
According to Sheet, associations of labor, state and military judges are already mobilizing to obtain the same advantages enjoyed by prosecutors who work in these branches of the Judiciary. In the Federal Court, civil servants who are not judges also demand improvements.
The resolution was approved unanimously on October 17 and was proposed by minister Luís Roberto Barroso, who president of the Federal Supreme Court (STF), also started to command the CNJ. “In the Brazilian institutional arrangement, a situation of inferiority of the Judiciary in relation to the Public Ministry is not accepted. The issue appears simple, one of mere compliance with the constitutional text”, he said at the time.
