Back from recess, the Senate may analyze the end of the “outdoor” for prisoners

With the return of legislative work, the Public Security Committee of the Federal Senate may analyze this Tuesday (6) the bill that provides for the end of the possibility of temporary release of prisoners, known as “sadinha”, and granted by the justice as a form of resocialization.

The text that proposes the end of “saidinha” was approved by the Chamber of Deputies in August last year, by 311 votes in favor and 98 against, and has been awaiting analysis by the Senate since March 2023. The discussion gained momentum in January, after the death of Minas Gerais sergeant Roger Dias da Cunha, shot by a prisoner who received the benefit and did not return to prison.

Currently, the legislation allows the benefit to prisoners in the semi-open regime who have already served at least one-sixth of their sentence, in the case of a first-time offender; and a fourth, if he is a repeat offender. Furthermore, appropriate behavior must be demonstrated.

The text that intends to change the legislation is reported by senator Flávio Bolsonaro (PL-RJ), who presented two reports in favor of the proposal — the most recent of which, in October —, but none of them were analyzed.

The project changes points in the Criminal Execution Law and the new proposal calls for the total abolition of the prisoner release benefit at certain times of the year, such as holidays.

According to the Security committee’s agenda, a new version of the report is expected to be presented and read by senator Flávio Bolsonaro in this Tuesday’s session (6).
