Arrested accused of participating in the events of January 8th, the usher and painter Claudinei Pego da Silva, aged 42, attempted suicide inside the cell where he is being held, in Papuda. The case occurred on Saturday (9).

Claudinei suffers from comorbidities and has already received an opinion from the Attorney General’s Office (PGR) in favor of release, but is still awaiting approval from the Minister of the Federal Supreme Court (STF), Alexandre de Moraes.

A People’s Gazette he spoke with the lawyer of another prisoner from 8/1 who was in Papuda to visit her client when the episode happened. Lawyer Gislaine Yamashita told the reporter that around 11 am – when she was beginning procedures with the penitentiary administration before gaining access to her client – she saw the arrival of the team from the Mobile Emergency Care Service (Samu) and asked employees about the reason for the movement, but received no response.

In the early afternoon, when he managed to speak to his client (a 63-year-old man), he had confirmation that Samu’s help was for Claudinei.

According to Gislaine, based on information from her client, the suicide attempt was prevented because other prisoners began shouting to attract the attention of prison staff, and one of them managed to reach the inmate’s cell in time.

The lawyer also revealed that her client “lives high” on medication to avoid suicide attempts.

Claudinei is on the list of 15 defendants who remain in prison despite a request for freedom made by the Attorney General’s Office (PGR). Claudinei has had a favorable opinion on release since October 9th.

What the State Secretariat for Penitentiary Administration (Seap) says

Questioned by the report about the circumstances of the suicide attempt and the health status of the detainee, the State Secretariat for Penitentiary Administration (Seap) did not respond to the contact of the People’s Gazette until the closing of this article. The newspaper remains open for any clarifications from the Secretariat.

The report from the Public Defender’s Office of the Federal District (DPDF), released on November 22, in which prisoners from 8/1 report mistreatment and abandonment by public authorities, brings Claudinei’s report, where the detainee reports suffering from comorbidities .

The report was published two days after the death of businessman Cleriston Pereira, who died in Papuda after warnings about his health were ignored by the STF minister, Alexandre de Moraes. Cleriston also had a PGR opinion in favor of release.

What the DF Health Secretary says

Wanted by People’s Gazettethe Health Department of the Federal District informed that “due to the legislation on confidentiality of medical records, it cannot provide information about patients treated in the public health network”.

“This measure, which protects the patient and the professional team, is supported by the Code of Medical Ethics, Chapter IX, Article 75, which prohibits doctors from ‘referencing identifiable clinical cases, displaying patients or their portraits in professional advertisements or publicity of medical matters, in the media in general, even with the patient’s authorization’”, says the note sent by the Secretariat to the newspaper.

DF has already been ordered to compensate the family of a prisoner who committed suicide in Papuda

In 2014, the 6th Civil Panel of the Federal District Court of Justice (TJDFT) confirmed a decision of the 2nd Finance Court that condemned the Federal District to pay compensation for moral damages and pension to the daughter of a prisoner who committed suicide inside Papuda.

“The daughter, represented by her mother, stated that her father was imprisoned in the Provisional Detention Center, when he presented serious psychiatric disorders, being diagnosed by a doctor with panic syndrome and was recommended to be transferred to an individual cell, pending psychiatric evaluation. However, due to the State’s neglect (negligence) in providing adequate medical care, days later, the detainee committed suicide, hanging himself with a blanket”, says an excerpt from a TJDF statement issued in October 2014.

In the 1st Instance, the judge upheld the compensation requests and ordered the DF to pay R$100,000 as moral damages and a pension of 2/3 of the minimum wage until the year 2033, when the daughter will turn 25 years old.
