Appointed by Lula to judge Lava Jato cases – 11/10/2023 – Frederico Vasconcelos

Lawyer Daniela Teixeira, appointed by President Luiz Inácio Lula da Silva (PT) to serve as minister of the STJ (Superior Court of Justice), should occupy the 5th Panel of the Court, where the Operation Lava Jato cases are judged.

Preference results from the choice of new ministers according to seniority. She expressed interest in the place. The Plateau too.

The announcement is likely to be made next week. As the press reported, the president of the Senate, Rodrigo Pacheco, has already sent the orders to the Presidency of the Republic with the names of the lawyer from Brasília and the judges José Afrânio Vilela, from Minas Gerais, and Teodoro Silva Santos, from Ceará.

On August 29, Lula sent a message to the Senate to consider Daniela’s name to fill the vacancy allocated to law at the STJ, resulting from the retirement of minister Felix Fischer.

At the beginning of the month, Pacheco suspended the sending of approved names to carry out an investigation, given the controversy over alleged favoritism to the lawyer, who would have preference in choosing the classes.

The Fifth Panel comprises ministers Messod Azulay Neto (president); Reynaldo Soares da Fonseca; Ribeiro Dantas; Joel Ilan Paciornik and João Batista Moreira (judge summoned from TRF-1).

From the OAB’s sixfold list, the STJ chose, in a secret vote, Luiz Cláudio Allemand, Otávio Luiz Rodrigues and Daniela Teixeira. She would not have received support from the STJ presidency.

The group Prerogativas condemned sexist attempts to deconstruct the lawyer’s candidacy. She has worked at the STF since 2000 and, since 2004, at the STJ.

Daniela led the OAB’s sixfold list for the STJ. She received votes from all sections of the Order. She was vice-president of the OAB-DF. She practiced law at Arnoldo Wald’s office. Former STJ president Asfor Rocha, still influential in the court, invited her to join Fiesp’s legal council.

Daniela has a master’s degree in criminal law from IDP and a postgraduate degree in economic law from FGV.

The lawyer defended Jacob Barata Filho, investigated in Lava Jato with Sérgio Cabral, former governor of Rio. The “king of buses” won three habeas corpus from Gilmar Mendes, best man at the wedding of the businessman’s daughter.

Daniela is the wife of journalist Miguel Matos, director of the Migalhas website.

During the hearing at the Constitution and Justice Committee, in the Senate, she defined her candidacy as follows:

“I brought, with my registration, the hard and suffering look of those who attend the Judiciary as plaintiff or defendant in the processes. Everyone finds the Judiciary complex, time-consuming and expensive. It is all this suffering of the parties that the representative of the fifth constitutional of Lawyers have the obligation to take to court: the urgency of those who are unjustly imprisoned, the haste of a businessman who is going to participate in a bidding process, is the decision that can save jobs in a company. Take the attention of the person for whom it is intended ultimately the Judiciary”.
