André Mendonça reports action requesting leniency suspension – 03/30/2023 – Panel

The action of three parties allied with President Luiz Inácio Lula da Silva (PT) in the STF (Supreme Federal Court) that asks for the suspension of the payment of fines of leniency agreements of Lava Jato companies will have Minister André Mendonça as rapporteur.

As a special advisor to the CGU (Controladoria Geral da União) between 2016 and 2018, Mendonça participated in the negotiation of six of these agreements.

He worked on the team of the minister responsible for the portfolio, Wagner Rosário, who requested him from the AGU (Advocacia Geral da União), where he was a civil servant, precisely to coordinate these negotiations. “He helped me a lot, he was fundamental for these agreements to be signed”, says Rosário.

Among the companies subject to agreements signed during the period Mendonça was at the CGU are contractors such as Odebrecht, UTC and Andrade Gutierrez, all targets of the operation.

According to people who follow the issue, the designation of Mendonça as rapporteur, made by lot, may indicate that the topic should not prosper in court. That is unless he declares himself offside.

The action was proposed by PSOL, PC do B and Solidariedade. One of the arguments is that the payment of fines by companies could make them financially unfeasible, with an impact on the level of employment.
