Parliamentary criticizes invasion of competence by the Judiciary and demands compliance with the Law regarding the nursing floor
Federal Deputy for Amazonas, Amom Mandel (Citizenship) denounced the interference of the Federal Supreme Court (STF) in the application of the national nursing floor, in a video published on social networks this Saturday (05). According to the parliamentarian, the decision represents an invasion of competence of the Judiciary in the face of the decisions of the Legislature.
In 2022, the National Congress enacted two amendments to the Federal Constitution that dealt with the subject and would guarantee the use of public funds to pay the minimum wage to nursing professionals. However, in a final decision to the Direct Action of Unconstitutionality (ADI) 7222, which deals with the floor, the rapporteur, Minister Luís Roberto Barroso, determined limitations on the application of Law No. 14,434, of 2022, which created the national floor.
The court’s decision determined, among other points, that the payment of the floor would be linked to transfers made by the Union, so as not to create expenses for states and municipalities without the necessary financial contribution. That is, only the structures covered by Union transfers would be served by the nursing floor. In the case of the private network, the payment of the floor would be subject to prior collective bargaining between the union and employers.
For Amom, the Law that provides for the nursing floor is legitimate, approved by the National Congress, and must be respected by the Judiciary.
“As a federal deputy in Brazil, I cannot fail to denounce the invasion of competences by the Judiciary Power in relation to the Legislative Power. The National Congress voted, approved and changed the nursing floor. And in absurd decisions, handed down by only one minister, all that changed and went down the drain. We need the political decision taken by parliamentarians to be respected.”
