Allan dos Santos must indemnify a Folha reporter – 05/09/2023 – Politics

The reporter’s lawsuit Sheet Patrícia Campos Mello against Allan do Santos, in which the founder of the Bolsonarist website Terça Livre was sentenced to indemnify the journalist, is officially closed, according to a publication by the TJ-SP (São Paulo Court of Justice).

The so-called final decision (when there are no more appeals) occurred after notary certification of the end of the deadline for appeal, which could have been filed by April 18.

As a result, Santos is obliged to pay R$ 35,000 for the damage caused to Patrícia, according to the unanimous decision of December 15 by judges Costa Netto, Ana Maria Baldy and Maria do Carmo Honório.

At the trial, Netto, who was rapporteur for the case, highlighted that the sexual expressions used by Santos to disqualify Patrícia are not protected by the right to freedom of expression, as decided by Judge Daniel Serpentino, of the 12th Civil Court of São Paulo, when deny the claim for compensation in the first instance, in August 2021.

In the decision, the magistrate states that Allan extrapolated the merely critical character and expression of opinion and exposed Patrícia to all kinds of embarrassment.

“Conducts like these must be vehemently repressed by the Judiciary, as in addition to being unethical, from a professional point of view, they cause immeasurable damage to the image and honor of the victim”, he said.

Taís Gasparian, lawyer at Sheet who defends the journalist, says that the consolidation of the conviction is a recognition that misogynistic and sexist attacks will not be admitted by the courts.

“The difficult thing will be to charge Allan dos Santos, who is on the run,” he said. The influencer has been in the United States since 2020. In January, the Ministry of Justice triggered the country and Interpol for him to be extradited.

In February 2020, after the former employee of the company Yacows Hans River lied to the Fake News CPMI that Patrícia had offered sex in exchange for information, Terça Livre broadcast the live “O Prostibulo em Desespero”, with several offenses to the journalist.

In addition to the transmission, Allan dos Santos attacked the reporter on social networks and disqualified the report that showed copies of the dialogue between Hans and Patrícia, contradicting his version.

“Is this whole operation full of FAKE print just to try to undo the possibility of a fuck by a scoop?”, “Did you see that, @camposmello? I think it’s better to put the nudes, if they occurred. It would be less shameful”, he published on social networks .

“I have no words to describe my indignation. To avoid cursing harlots in search of a scoop, I will only say this to journalists of selective morality: they will take it in the ass”, he wrote in another post.

Also for offending the journalist’s honor, the Justice of São Paulo has already confirmed the conviction of President Jair Bolsonaro and federal deputy Eduardo Bolsonaro (PL-SP), sentenced to pay R$ 35,000 to the journalist, and federal deputy André Fernandes ( PL-CE), condemned to compensate her in BRL 50 thousand.

In February, the conviction against Hans River, dated April 2021, was annulled on technical grounds. The defense is still awaiting a decision in this case.
