Alexandre de Moraes orders the release of a group of prisoners on the 8th of January

The Minister of the Federal Supreme Court (STF) Alexandre de Moraes ordered on Monday night (27) the release of at least 102 people who were detained after the acts of depredation that took place on January 8 at Praça dos Três Poderes, in Brasília .

He determined that all those released should wear electronic anklets and be prohibited from leaving the country, according to the g1 portal. The process is confidential. Around 800 people remain in detention.

The beneficiaries, who were in the prisons of Papuda (men) and Colmeia (women), are also obliged to comply with home confinement during nights and weekends. Finally, its order orders that these people present themselves to the Judgment of the Execution of the Comarca of origin in 24 hours and, later, to appear weekly, every Monday.

Parliamentarians heard by People’s Gazette reported that the news about the release of prisoners began to circulate in the backstage of the federal capital last night.

Last Saturday, Moraes defined that prisoners, whose arrests took effect on January 9, could receive visits according to the general rules of the local prison system, provided for in Ordinance 008/2016 of the Criminal Execution Court (VEP) of the Federal District, contemplating situations exceptional.

On January 20, Alexandre de Moraes concluded the analysis of the situation of those arrested for involvement in the destruction of public buildings, headquarters of the Powers of the Republic. Minutes of hearing relating to 1,406 in custody were analyzed. Of these, 942 people were arrested in flagrante delicto converted into preventive and another 464 obtained provisional release, through precautionary measures, being able to respond to the process through the use of an electronic anklet, among other measures.

The argument for preventive arrests was that it was necessary to guarantee public order and the effectiveness of investigations. The minister pointed to evidence of crimes of terrorism, criminal association, violent abolition of the democratic rule of law, coup d’état, threat, persecution and incitement to crime.

Regarding those who were in the first wave of releases, the minister considered that, although there were strong indications of authorship in the crimes, no evidence had been obtained of the practice of violence, invasion of buildings and depredation of public property. Therefore, he understood that it was possible to replace prison with precautionary measures.
