This Wednesday (17th) STF (Federal Supreme Court) minister Alexandre de Moraes accepted a lawsuit against MP (provisional measure) 1150/2022, which postpones sanctions for deforesters.
The text, edited at the end of the lights of the government of Jair Bolsonaro (PL), extends the deadline for the producer to enroll in the CAR (Rural Environmental Registry), a prerequisite for joining the regularization program. This deadline ended in 2021, but as of the edition of the norm, it was postponed in 180 days from the notification of the supervisory bodies. In practice, it postponed the application of sanctions and compensatory measures to deforestation.
Alexandre de Moraes asked the Planalto Palace and the National Congress for clarification on the MP, to be provided within a period of ten days.
The action was filed by the Green Party. The piece, signed by lawyers Lauro Moraes Rêgo and Caio Coelho, asks that the exception be considered unconstitutional.
When analyzing in the Chamber, deputies made the preservation of the Atlantic Forest even more flexible, by allowing the deforestation of primary and secondary vegetation in the advanced stage of regeneration by withdrawing the requirement, currently foreseen in the law, that this could only occur when “there is no technical and locational alternative to the proposed undertaking”.
The Senate approved it on Tuesday (16), but removing the grafts made in the Chamber. The text now returns to the analysis of the deputies.
