Alesp wants to hear health plans about autistic people – 05/16/2023 – Panel

The Defense Committee for People with Disabilities of the Legislative Assembly of São Paulo approved this Tuesday (16) an invitation for representatives of Abramge (Brazilian Association of Health Plans) and FenaSaúde (National Federation of Supplementary Health) to attend the House to explain the complaints of dozens of cancellations of contracts and disqualification of clinics that offer therapies for autistic children.

The proposal was presented by Deputy Andréa Werner (PSB), president of the commission, whose office received more than 190 complaints about operators that are unilaterally canceling the contract of families with autistic children or those undergoing cancer treatment. The practice, in the understanding of the parliamentarian, violates an understanding already pacified by the STJ (Superior Court of Justice).

“We invite Fenasaúde to speak for the entire sector. The vast majority of complaints [cerca de 90%] that we received refers to Unimed, but there are other operators that have replicated the practice since the end of April. Abramge, on the other hand, invited them to talk mainly about the disqualification of clinics and the verticalization of care, but also about the cancellation of plans by some of its members”, says the deputy.

In a note to UOL’s report on the subject, Unimed said that “the unilateral termination of collective agreements is a possibility provided for in the contract and in the rules defined by the National Supplementary Health Agency (ANS)”.

The commission’s next meeting is expected to take place in two weeks. In addition to the commission at Alesp, the state Public Prosecutor’s Office, via the Consumer Defense Prosecutor’s Office, with which Andrea met this Monday (15), investigates the case in a public civil inquiry.
