AGU will propose Lula to veto environmental offenders – 12/01/2023 – Mônica Bergamo

The AGU (Attorney General of the Union), led by Jorge Messias, will present to President Lula (PT) an opinion in which it proposes to veto access to tenders and contracts with the public administration to people or organizations that have committed infractions considered “especially serious “against the environment.

If approved by the Presidency, the measure will be valid for both individuals and legal entities. The document is in the process of being finalized and should be dispatched later this year.

In the opinion, the AGU specifies three types of qualified violations of the environment that could be considered serious and generate administrative proceedings. They are: fire and deforestation infractions in areas exceeding one thousand hectares, mistreatment of dogs and cats that leads to the death of the animal and preparation or presentation of false documents to environmental agencies in case of significant damage.

The body maintains that sustainable national development is the premise of the State’s actions, and that infractions that harm the environment in a particularly serious way attack an essential value of the Constitution.

RANGE

If the opinion is approved, all federal public administration bodies will be bound by it, including local authorities and public companies. The AGU stipulates that the investigation of unsuitability, when suspected, takes place through an administrative process that respects the constitutional guarantees of full defense and legal process.

EFFORTS

The preparation of the proposal is an initiative that came from AGU itself, integrating a series of actions led by the current management in favor of the environment. In January of this year, Messias created the National Attorney’s Office for the Defense of Climate and the Environment, which is dedicated exclusively to the topic.
