AGU accounts for savings of BRL 286 billion to public coffers – 06/27/2023 – Panel

According to the accounts of the AGU (Advocacy General of the Union), the portfolio managed to avoid expenses that add up to R$ 286 billion from its performance in superior courts since the beginning of the year.

The calculation takes into account favorable decisions on taxation and payment of civil servants, agreements and collection of fees and fines.

The case with the greatest impact, R$ 115 billion, concerns the collection of PIS and Cofins on financial intermediation by banks, such as loans and financing. AGU’s thesis was victorious in judgment earlier this month.

The portfolio’s positions also prevailed in actions that discussed more than R$ 30 billion in salary readjustments, payment of bonuses and equalization between careers.

An additional R$42.1 billion was saved from public coffers through the signing of 23,000 agreements. In this case, discounts applied in conciliations in which the parties agreed to receive from the Union amounts lower than those initially claimed were considered, in addition to savings with interest and monetary correction that would apply if the litigation was prolonged.

One of the biggest agreements signed under the new administration was with Cesp (Companhia Energética de São Paulo) in a lawsuit in which the company demanded compensation for assets not amortized during the concession contract for the construction of the Três Irmãos Hydroelectric Power Plant.

There was also the collection of R$ 2.4 billion in fines imposed by municipalities and federal public foundations such as Ibama (Brazilian Institute for the Environment and Renewable Natural Resources), Anatel (National Telecommunications Agency), ANS (National Supplementary Health Agency) and others.

“The country is making a great effort to create more solid foundations for fiscal balance and, at the same time, rebuild vital public policies that were dismantled in recent years, which requires resources”, says the Union’s attorney general, Jorge Messias .
