The Brazilian Association of Conservative Jurists (Abrajuc) released, this Sunday (30), a note of repudiation in relation to the Fake News PL, “because it understands that the said PL conceives a flagrantly unconstitutional legal framework, similar to those existing in anti-democratic regimes” .

According to Abrajuc, the project that will be voted on in the Plenary of the Chamber of Deputies, next Tuesday (2), “is offensive to the constitutional text and is already born spurious, injuring democratic principles to death”. “It is not up to an infraconstitutional norm to repress, subtract or steal a fundamental right contained in the Magna Carta and classified as an ironclad clause”, says the association, in reference to freedom of expression.

Jurists point out that the Penal Code has “devices necessary to repress and discourage” any type of excess, such as, for example, crimes against honor. “The simple fact of considering an Internet regulation law and, consequently, the regulation of thought and opinions that will be modulated by an agent hitherto unknown, proves the dark times we live in, times in which, more than never, it is urgent that we remain faithful and irresolute to the principles of our founding fathers”, says Abrajuc.

Finally, the association asks the National Congress to “return to its institutional and constitutional mission of defending democracy, freedom and the Brazilian people”.
