Soccer player Daniel Alves declared this Monday (17) that the sexual relationship with the young woman who accused him of rape on December 30 last year was consensual and that the victim may have denounced him for the lack of intimacy after the act.
He has been in the Brians penitentiary center in the metropolitan area of Barcelona since January 20. He was arrested due to risk of fleeing, pointed out the judge at the time. At the defense’s request, the Brazilian made this second statement before the trial, which still has no date set.
According to sources in the Spanish press, Alves said on Monday that he has always had respectful relationships with women and that he does not take a step without realizing that there is a connection and predisposition on both sides.
Alves also said that the interest between them was mutual and there was sexual tension from the moment they met, in the VIP area of the Sutton nightclub, in Barcelona.
At a certain point, according to these sources that accompanied the testimony, he was asked why the young woman accused him of rape. Alves replied that he believed that, because they agreed to leave the bathroom separately and act discreetly, without him showing attention or affection after the act, she may have been offended.
Alves again gave his version of events, saying that he arrived at the scene with his friend Bruno Brasil and was directed by the nightclub staff to table 6 in the VIP area, as always, for security reasons.
There they met the three girls and, according to him, they danced and talked, mainly with the alleged victim. Then he says he proposed going to a private place and they went to the bathroom. According to him, she would have accepted and gone to the bathroom alone.
Everything that happened inside the bathroom was a free and voluntary act, he declared. According to Alves, they had sex and she never said to stop. At this point, the player said he had always respected women and never acted negatively towards them.
CHARGE OF RAPE AND ARREST
According to her testimony, Alves called them to the VIP area of the club and offered glasses of cava (sparkling wine produced in Catalonia), which they refused.
So, the player would have placed himself behind the young woman. “He took my hand, put it on his penis and I took it off,” he said in the deposition. Alves would have taken her to the bathroom, where he would have said “that I couldn’t leave and that I had to tell him that I was his little whore”.
According to her testimony to Justice, Alves would have forced the woman’s head onto his penis and then slapped her. Then, he would have turned the young woman into position and penetrated her until he ejaculated.
Daniel Alves would have said, then, “I’m going to leave first”. After informing the security guards, the victim was seen at Hospital Clínic, whose medical report would point to traits consistent with an assault.
In his first statement, Daniel Alves contradicted himself by saying that there was a consensual relationship. Before, however, he had said that he did not know and had not been involved with the alleged victim.
Afterwards, the defense admitted that the player changed his version and started to work with the idea that there was a “consensual relationship” with the alleged victim.
The player is still in prison awaiting the trial, still no date set. The defense is considering filing a second request for provisional release in the coming days. The first was denied, due to the possibility of flight risk.
