Parents also need to be aware of changes in behavior, points out Eduarda Horta, a lawyer specializing in cybersecurity. ➤ Step 3: Make a report in person at the police station. For this, Iolanda recommends writing an email in English, explaining the situation and sending a photo of yourself with your document, covering the number, proving that it really is you. The section that says “do another libidinous act” is where virtual rape fits, as it concerns forcing the production of sexual material and using it for one’s own pleasure, explains Iolanda. Another point where the crime fits is that the content is obtained “under serious threat”. “He obliges, he forces, he rapes the victim. That’s why it’s rape in fact,” she says. “The consequences are the same as those of a carnal rape”, she completes. There is also Bill 3628/20 that wants to legalize the term “virtual rape”, including article 217 B in the Penal Code. The PL would criminalize “harassing, instigating or constraining, by any means of communication, minors under 14 years of age, to exhibit themselves in a pornographic or sexually explicit manner”. One of the differences to the crime of rape is that article 217 B proposes a lower penalty, from 4 to 12 years in prison, while the current rape penalty against minors under 14 determines imprisonment from 8 to 15 years. “I, in particular, understand that this should not be the case, because both cybercrime and physical crime have an impact on the victim, whether psychologically or emotionally”, says lawyer Eduarda. Despite this, the specialist in cyber crimes believes that the approval of the law is important, since there is still the possibility that judges will not classify virtual rapes as rape, but as harassment or stalking. That is why, when the scammer presents himself, the teenager tends not to give in to blackmail to protect the alleged photo. “So, I see that, to a large extent, people who are most attacked by this type of criminal are more connected to a group of people who are conservative and tend to conserve and shield their image”, says the researcher. There is also a moral issue. While the older generation feels they’ve done something wrong when images are leaked, the younger generation is enjoying the sexy positive movement, which provides less judgment for leaked images and their sexuality, she says.
