The veterinarian was approached by the People’s Gazette, but preferred to speak out through lawyer Rodrigo Mendes Antunes, who hoped for his client’s release. He classified the period until the STF’s decision as “absurdly long”.

“He was mentioned in the same decision that removed the governor of the Federal District. At that moment, we ourselves petitioned Minister Alexandre de Moraes and he was ready to provide clarification, but he was never called. It turns out that, months later, he came preventive detention and search and seizure”, explains the lawyer when remembering the Lesa Pátria operation.

In early December, Matos’ wife, Lúminna Hoffmann, gave an interview to Gazeta do Povo columnist Cristina Graeml and said that her husband was at the demonstration and immediately returned to Paraná when the peaceful act turned into widespread confusion. Without a formal report on the case, the request to revoke the arrest was made due to the excess of time. “He wouldn’t leave. The minister would simply deny it, or he would be sent to the PGR, which would remain silent and not provide any type of information. There are five days to file a complaint and this has not been done for months“, argues the lawyer.

“He was trapped responding to something that didn’t even exist. A totally unusual situation. So many serious crimes committed in the country and people leaving through the front door, it’s really impossible to understand”, says Antunes.

Veterinarian’s departure leads to request in similar cases on January 8

Lawyer Rodrigo Mendes Antunes claims that Matos’ release was the kick-off for the request of other lawyers in the same senseespecially in cases where prisoners do not have a technical defense available to guarantee their freedom.

“We waited for 90 days to renew the arrest and on the 91st, we made a request for an excess of time demanding his release. We also started to raise the issue of the lack of a complaint, which culminated in the minister’s decision, still without the demonstration by the PGR”, he criticizes. According to him, six other prisoners from Operação Lesa Pátria also benefited from their release.

A new arrest, according to the lawyer, will only happen if the person under investigation fails to comply with measures imposed by Moraes. The precautionary measures include nightly retirement, monitoring and the obligation to appear before the Execution Court of the District of origin, within 48 hours, in addition to weekly attendance.
