USP: Janaina Paschoal gives test on shooting strikers – 10/06/2023 – Education

An online activity applied to the General Theory of Criminal Law subject outraged students at the Faculty of Law at USP (University of São Paulo) this Thursday (5). The second question, formulated by teacher and former state deputy Janaina Paschoal, simulated the case of a teacher who, surrounded and threatened, shoots at students in the middle of a strike.

Afterwards, an analysis of the man’s conduct is requested based on the Penal Code.

USP students have been on strike since September 18th to hire more teachers.

In the unit responsible for legal training, São Francisco, the movement was embraced a week later. Students occupy the building and block access to rooms. Educators opposed to the strike try to continue with online classes and report intimidation. The management issued a statement criticizing the student movement.

The report heard students who said the activity was “provocative” and “irresponsible”.

A Sheet Janaina Paschoal says she created an exercise consistent with the discipline taught. “I gave a practical question of a conflict. In many tests, I gave practical examples of other crimes. These specific cases are inherent to the activities, the classes, the tests”, she declares. “I don’t understand the interest in this,” she continues.

Since the beginning of the class boycott, the teacher has published demonstrations in repudiation of the situation and the strikers’ procedures.

This Friday (6), students from the university’s Polytechnic School, Poli, approved the end of the strike at the unit through a plebiscite. Half of the almost 5,000 registered voters voted. There were 1,214 against the continuation of the strike, 1,129 in favor and 71 abstentions.

With this, the department responsible for training engineers becomes the first to break the boycott of classes in Cidade Universitária. The others will hold a joint assembly on Monday (9) to define the future of the movement.

Members of Adusp (Teachers’ Association of the University of São Paulo), however, have already decided to remain on standby until next Tuesday (10). They intend to follow the directives of the students participating in Monday’s meeting.

“In the midst of a student strike, a teacher insists on teaching his classes. The organizers of the movement, outraged, in a WhatsApp group, agreed to surround the teacher in his vehicle, upon his arrival at the educational institution.

A student opposed to the strike sends a printout of the messages to the teacher who, frightened, takes a revolver with him. In this case, the teacher carries the weapon due to another professional activity that he carries out in parallel and on an absolutely regular basis.

Well, on the day of class, the teacher normally goes to his academic activities and, actually, at the entrance to the parking lot, he is surrounded by people with their faces covered, who begin to vandalize his car, demanding that he get out. Afraid, the teacher accelerates the vehicle and one of the attackers manages to open the car door, pulling him out. At this moment, certain that he would be beaten, the teacher fired the revolver, injuring a student who was passing by and had no connection with the situation.

Based on the Penal Code, analyze the teacher’s conduct and, knowing that the student who gave the idea did not participate in the siege, also analyze the conduct of that student.”
