The TSE (Superior Electoral Court) condemned deputies Nikolas Ferreira (PL), Carla Zambelli (PL), Eduardo Bolsonaro (PL) and senator Flávio Bolsonaro (PL) for disseminating a video with false content about President Lula (PT) in the 2022 elections.
In the video, Nikolas accuses Lula of encouraging drug use by children and adolescents and associates the phrase “do the L” with criminality and censorship on networks. Carla Zambelli and the children of former President Bolsonaro shared the content.
President Lula’s Coligação Brasil da Esperança filed a representation at the TSE questioning the irregular electoral propaganda on the internet with “illicit and immoral” practices.
Lawyer Thiago Rocha, who defended the parliamentarians, argued that the video has no false content. “By sharing the video, those represented did not at any time deal with an untrue fact, but limited themselves to sharing a criticism, albeit in an acidic way,” he said.
By majority, ministers Sérgio Banhos, Alexandre de Moraes, Cármen Lúcia, Benedito Gonçalves and Carlos Horbach decided that the video goes beyond legal limits.
The rapporteur of the case, Raul Araújo, voted to deny the appeal of Coligação Brasil da Esperança. He was accompanied by minister Nunes Marques.
The amount of the fine has not yet been fixed. The ministers also determined the removal of the content.
In December, Lula’s coalition activated the TSE and managed to remove the video from the air, but Minister Raul Araújo ended the action without trial because the election period had passed. The Coligação Brasil da Esperança appealed the decision and the appeal was analyzed this Thursday (11).
