Digital Inclusion Point guarantees access for the indigenous population to the Labor Court in São Gabriel da Cachoeira

São Gabriel da Cachoeira (AM) – A hearing at the Regional Labor Court of the 11th Region (AM/RR) held last Monday (6), inaugurated the Digital Inclusion Point (PID) in São Gabriel da Cachoeira, 852 kilometers northwest of Manaus. The highlight of the hearing was the agreement benefiting an indigenous worker, with payment of R$4,000 relating to the Severance Indemnity Fund (FGTS) claimed by the employee.

The result confirms the importance of PIDs in allowing access to Labor Court services. The São Gabriel da Cachoeira PID operates at the headquarters of the Federation of Indigenous Organizations of Rio Negro (Foirn), an entity that represents 750 communities and ethnicities in that region.

With this point, they now have computerized access to the Labor Court, being able to file lawsuits, participate in hearings and have access to procedural monitoring.

The municipality is recognized as the “most indigenous in the country” and the hearing on the 6th reflects the local reality. The complainant is a self-declared indigenous Baré, while the municipal attorney Eduardo Gabriel Alves, present at the hearing, is of the Tariano ethnic group. Currently, 95% of complaints filed in the municipality are from self-declared indigenous people.

The hearing was conducted by the head judge of the Presidente Figueiredo Labor Court, with jurisdiction also over São Gabriel da Cachoeira, Sandro Nahmias and held within the scope of the National Conciliation Week, held annually by the National Justice Council (CNJ). The president of the TRT-11, judge Audaliphal Hidelbrando da Silva and the assistant judge of the presidency of the TRT-11, Carolina França, participated remotely in the hearing.

According to judge Sandro Nahmias Melo, with the PID, the TRT-11 fulfills its role of being increasingly accessible to the parties, a priority defended by the management of judge Audaliphal Hidelbrando.

“We made TRT-11 closer to geographically distant municipalities. We are fulfilling the mission of making the Labor Court more present and accessible”,

said the magistrate.

The president of TRT-11, Audaliphal Hidelbrando, highlighted the importance of including São Gabriel da Cachoeira, especially for the indigenous community. He recalled that he received the title of citizen of the municipality for his work at the head of the Labor Court and also for living and completing a large part of his military career there.

“This was an important hearing for conciliation, integration and bringing justice closer, in São Gabriel da Cachoeira. This municipality has a diversity of ethnicities and indigenous languages to the point of having received minister Rosa Weber (at the time president of the Federal Supreme Court) for the inauguration of the Constitution in Neengatu”,

he stressed.
